Mr. Borkowski, Ms. Herscovici and Mr. Sabele will share sample documents and discuss the best ways to use submissions in the arbitration and mediation forums. Different strategies and perspectives on arbitration and mediation and the pros and cons of each method will also be presented.

About the presenters

Mr. Borkowski's distinguished career spans more than 30 years with a practice focused primarily on litigation at the trial and appellate levels in both the state and federal court systems. He has represented insurance carriers, corporations and individuals in personal injury, construction, litigation, general liability, premises liability, property damage, automobile and commercial litigation (both plaintiff and defendant). Mr. Borkowski is well-known within the New York Metro area legal community, having served as lead trial counsel for hundreds of cases in nearly every county, and in all five boroughs of New York City. In 2021, for the second year in a row, Mr. Borkowski was voted a Top Ten Arbitrator in the New York Law Journal Best of Survey.

Ms. Herscovici is a former Senior Counsel, Negotiator for the New York City Law Department's Tort Division. She has settled thousands of cases in actions involving claims of various types of negligence, labor law, defamation and civil rights violations. Additionally, her many years of trial practice experience has resulted in taking to verdict numerous high exposure cases. As a neutral for NAM, she draws from her significant experience handling complex negotiations and is recognized by her peers as an authority in negotiation and settlement.  Throughout her many years of experience negotiating cases and settling disputes, she has gained a reputation for her extensive knowledge in numerous areas of law including negligence, premises liability, tort and product liability and personal injury. In 2021, for the second year in a row, Ms. Herscovici was voted a Top Ten Arbitrator in the New York Law Journal Best of Survey.

Mr. Sabele has been engaged in the practice of law for more than 30 years and is highly regarded for his ability to resolve cases concerning personal injury and civil litigation disputes. Throughout his career, he has handled numerous matters and has settled, litigated and tried a diverse caseload, served as a neutral for numerous personal injury cases and other types of matters involving negligence and is highly respected by both the plaintiff and defense bars alike. As a partner and senior trial attorney for a prominent New York law firm, he represented parties in the areas of personal injury, negligence, accidents, legal malpractice, medical malpractice, product liability, nursing home accidents, elevator accidents, slip and fall and wrongful death and labor law violations. Mr. Sabele was voted a Top Ten Arbitrator in the 2021 New York Law Journal Annual Best Of Survey. He is an exceptionally well-rounded and effective neutral known for his keen legal acumen and negotiating abilities, and has garnered a reputation for being fair, levelheaded, and approachable.
